Alliance Defending Freedom has been successful in fighting for the freedom to oppose same sex-marriage through their representation of Jack Phillips, a baker who refused to bake a cake for a same-sex couple in 2012. According to Alliance Defending Freedom, this was not because Jack Philips had anti-gay sentiments against them, but because he served everyone in his shop, and it would violate his religious belief to force him to use his artistic ability to celebrate something he didn’t believe in. Alliance Defending Freedom filed a lawsuit against Colorado’s Civil Rights Commission on behalf of the Colorado cake artist, who ultimately won after the Supreme Court agreed with his assertion that his religious freedom had been violated.
Another case study is over the issue of religious freedom. The Defending Freedom is currently defending a pastor in Kentucky named Joseph Stapleton who was threatened with jail time for having a dispute with a county clerk over his right to preach against same-sex marriage. This was a violation of his First Amendment rights and the Alliance Defending Freedom represented him, leading the Kentucky Supreme Court to rule in his favor as well as forcing the county clerk to back off and stop threatening him.
